People Filing Chantix Lawsuits Approach US Judicial Panel On Multidistrict Litigation To Merge All Cases In One Court
Date: 8 th July 2009
Alleging that Pfizer Incl., the manufacturer of the quit smoking medicine Chantix, has failed to undertake thorough research on the medication as well as in sending warning signals to the public regarding the hazardous side-effects triggered off by the drug such as unusual violent behavior, injuries from suicide attempts et al, a range of chantix lawsuits are being filed by people in several federal district courts. Sources further make it apparent that these complainants have approached the U.S. Judicial Panel on Multidistrict Litigation (MDL) asking to consolidate all chantix cases in one court for the purpose of making the pretrial legal proceedings organized and coordinated.
It is further known that on 2 nd July 2009, around 20 people who had initiated chantix lawsuits had filed a motion asking for the consolidation of all chantix lawsuits in a Multidistrict Litigation (MDL) to serve the convenience of the witnesses, court and parties as well as to repeat discovery of issues common to all cases and further to avoid incoherent pretrial rulings.
According to specific sources, the plaintiffs have vehemently argued that if all chantix cases are not coordinated and consolidated in one court, some of the common issues associated with generic experts and discovery would be repeated and then the parties as well as the judiciary would have to waste money, time and resources.
Around 20 chantix lawsuits marked out by the plaintiff parties are spread among at least ten different federal district courts and not a single court controlled most of the cases. However, the complainants filing the petition suggested the transference of all cases to the “Northern District of Alabama” or the “Northern District of Georgia”.
